Preamble

The general conditions of use (hereinafter called the General Conditions of Use) describe the terms and conditions under which the Swiss Rugby Union (hereinafter called FSR) provides an online information service for Rugby in Switzerland and for sports administration relating to the life of the FSR (hereinafter called the Service).

SuisseRugby is the name of the technical platform (scripts, programs and methods) and shall not be limited to just one website http://www.suisserigby.com/ but also includes :

Intellectual property

All elements, including trademarks, logos and names of domains appearing on SuisseRugby, are protected by current laws on intellectual property and are the property of the FSR or are the subject of a utilisation authorisation.

No element that is a component of SuisseRugby may be copied, reproduced, modified, re-edited, downloaded, misrepresented, transmitted or distributed in any way whatsoever, using any medium whatsoever, partially or wholely, without the express written and prior permission of the FSR with the exception of a use that is strictly for the needs of the press and subject to the respecting of the intellectual property laws and of any other ownership law of which mention is made.

Any representation either total or partial of SuisseRugby through any process whatsoever,that is without the express authorisation of the FSR is forbidden and shall constitute an infringement sanctioned by the currently valid law.

SuisseRUgby reserves the right to take legal action against any act that infinges its intellectual property rights. The only copying for private usage that is authorised is that for personal,private and non-commercial usage. Any authorised use of elements that are are components of or that figure on SuisseRugby must be made without misrepresentation or alteration in any way whatsoever.

Accessibility of the Service

Access to the service is subject to the respecting of these present General Conditions of Use. No user may access this service without having taken note of this and in so doing undertakes to unreservedly respect these.

In order to access his management tool, the User must connect to the Website http:// www.suisserigby.com/ and identtify him/herself by means of his/her login and his/her password , which he/she will have previously transcribed in the fields dedicated for this purpose.

When subscribing online for the opening of a Webpage, the User undertakes to strictly provide true, precise, up-to=date and complete information about himself within the limits that will be required of him. Once the form has been submitted to the registrations department, the user is informed that he must confirm his membership within 24 hours following his request by clicking on or copying into his Internet navigation system the temporary and personal URL confirmation address received at his email address that is stated as being his/hers when submitting the form.

Following this confirmation, he/she will then be informed of the firm and definitive opening by SuisseRugby of his/her Webpage.Should the user have provided false, imprecise or incomplete information, SuisseRugby, as soon as its departments shall have become aware of this, shall have the right to suspend or cancel the User's account with immediate effect and to refuse his/her access to all or part of the Service immediately and in the future.

User's obligations

The User shall administrate only and by means of a management tool made available by SuisseRugby and accessible online by password and login. The User guarantees the confidentiality of the password that is used to access the Service and accepts to bear all of the responsibilities linked to actions made with the use of this password. The User of this present website acknowledges having at his/her disposal the necessary competence and means in order to gain access to SuisseRugby, with the User having verified that his/her information technology-related configuration that is used does not contain any virus and that it is in a perfect operational state.

The User undertakes that the contents of statements made by him/her on SuisseRugby shall be in conformity with current laws and regulations. It should be remebered that the user alone is respopsnible for the content of whatever he/she distrubutes on the Internet and in no case whall the FSR be comnsidered as being responsible for the contents of a User. The User undertakes that his.her content :

  • shall not violate or be contrary to pubic order, or offend public morals or be prejudicial to the sensitivity of minors
  • shall not encourage excessive eating disorders
  • shall not violate in any way whatsoever the rights of indiviual persons, the private lives and image of third parties
  • shall not be disparaging, defamatory and violating the image and the reputation of a brand or of any physical or moral person in any manner whatsoever
  • shall not be of a pornographic or paedophiliac charactere
  • shall not violate the security or the integrity of a State or of a territory in any respect
  • shall not violate the intellectual property rights of any person whatsoever
  • shall not incite hatred, violence, suicide, racism, anti-semitism, xenophobia, homophobia, provide excuses for war-crimes or crimes against humanity
  • shall not incite the committing of a crime, an offence or an act of terrorism
  • shall not incite discrimination against a person or a group of persons by reason of their belonging to an ethnic group, a religion, a race or due to their sexual orientation or being handicapped

Furthermore the User undertakes :

  • to guarantee that all information, data. files, films, photographs, software or databases are his/her property and are free of copyright restrictions
  • not to use the tools made available by SuisseRugby for any purposes other than those for which they are destined.
  • In other events for the use, the reproduction, the representation or the communication to the public of an intellectual work belonging to a third party and protected by law (and in particular but not exclusively software, databases, intellectual works, brands, company names, patents, drawings and models), to obtain a prior authoristaion or licence for use from the owners of such rights, in the conditions set by the laws
  • and not to include addresses or hypertext links to external websites which may be contrary to the currently valid laws and regulations and which may infringe the rights of third parties or which may be contrary to these present General Conditions of Use
  • to guarantee the confidentiality of the password that provides access to the Service and accepts to bear all of the responsibilities linked to actions undertaken with this password
  • to inform the FSR without delay of any legal action and of any complaint with respect to the contents of SuisseRugby. He/she must respond to requests for information from SuisseRugby, in particular in relation to matters concerning any content that is presumed to be contrary to the rules of proper behaviour

Force majeure

SuisseRugby may not be held responsible, or be considered as having failed in these present conditions, for any delay or failure to perform, when the cause of the delay or of such failure to perform shall be linked to an event of force majeure including therein the breakdown, the suspension, the reduction or the disturbance of electricity or other failures in the telecommunications network.

However, the User acknowledges being aware of the fact that suppliers of materials, software and telecommunications infrastructures used in these domains, do not offer any absolute guarantee of the perfect functioning of the service.

As a user of technologies or infrastructures that are developed and supplied by third parties, SuisseRugby shall not give any undertaking that its service will be totally free from breakdowns and without any delays, especially in the event of a "bug" or the updating of the service.

Furthermore, the FSR reserves the right to possibly amend the content of the page http://www.suisserugby.com/ and that of the Users' administration page at its sole discretion, at any time and without prior warning. SuisseRugby reserves the right to possibly make SuisseRugby temporarily unavailable due to maintenance or updating procedures.
